Idaho statutes govern the process.
- An exemplified copy of the foreign judgment must be obtained.
- It is essential that the foreign judgment then is recorded in the county where the debtor resides or maintains the property.
- After the exemplified copy of the foreign judgment is successfully recorded, the debtor will be notified by the Clerk of the Court informing them a foreign judgment was filed and has been recorded.
- There is a waiting period after the judgment has been recorded before collection actions can begin.
Like the domestication process, the collection process is also governed by the Idaho statute. Certain assets and resources of the debtor are exempt from collection.
If you hold a foreign judgment and desire to satisfy that judgment through the recovery of the debtor’s assets located in Idaho, contact Dean Law.
