REAL ESTATE LITIGATION

A person sometimes needs real estate litigation to pursue their real property rights. Ideally, pre-litigation efforts will be successful, and litigation can be avoided. However, at times, real estate agents, brokers, buyers, sellers, landlords, tenants, contractors, developers, and lenders may have no practical alternative but to resort to the Courts to remedy a grievance or seek compensation for a wrong. Many property disputes stem from the following:

  • Breach of contract
  • Trespass
  • Nuisance
  • Failure to disclose property conditions or defects
  • Negligence

Real property disputes and the issues involved are often broad and varied. Having the right legal advice will provide you the confidence that your rights are being adequately represented and protected. The lawyers at Dean Law use their knowledge of the law and experience to protect your rights. We work on your behalf to make sure your interests are fully served to the full extent of the law.

REDUCING REAL ESTATE LITIGATION COSTS

Litigation can be costly. At Dean Law, we are sensitive to the client’s budget. If you are in a property dispute, our goal is to optimize your outcome by first understanding your goals and objectives. We strategize with you and assess how to achieve the desired resolution. We realize the importance of alternate dispute resolution methods such as arbitration, mediation, negotiated settlements, and the non-binding neutral case evaluation under Idaho’s Small Lawsuit Resolution Act.

We use our experience in these areas to achieve a satisfactory result for the client, which can be less costly and less time consuming than a trial.
