Common types of business disputes involve:
- Breach of Contract – In general, a contract is an enforceable promise between two people. If one person breaks their promise without legal excuse, they have breached the contract. Contract defaults vary since there are a variety of business agreements.
- Employment Disputes – The employer-employee relationship is subject to both state and federal laws and regulations. An employment contract or employee handbook may create additional rights and duties. Disputes between employers and employee can involve: discrimination; harassment; wage claims, wrongful discharge; misappropriation of trade secrets and confidential information; post-employment restrictive covenants; and workplace safety issues.
- Tortious Interference with Contract – This type of claim arises when a person wrongfully interferes with an existing contractual relationship to which they are not a party and the interference damages one or more parties to the contract.
- Breach of Fiduciary Duty – This occurs when one acts in the interest of themselves to obtain personal advantage while knowingly disregarding the best interest of the employer or principal.
- Misleading and Deceptive Trade Practices – Entails activity which is dishonest and deceiving and misleads or lures someone into purchasing a product or service.
- Antitrust Violations – Both Federal and State laws regulate commerce and trade. In general, these laws and regulations prohibit abusive practices such as price-fixing, restraints, price discrimination, and monopolization which have the result of reducing competition and limiting consumer choices.
At Dean Law, we strive to solve client’s business disputes efficiently and effectively by applying our knowledge and experience in pre-litigation negotiation, mediation, arbitration, trial, and appeal.
